1. Introduction and Acceptance

These Terms & Conditions (“Terms”) govern your access to and use of the website (www.atomic-computing.com) (the “Website”) and, where applicable, general engagement with Atomic Computing’s services, operated by:

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website. These Terms do not replace or override any signed Master Services Agreement (MSA), Statement of Work (SOW), or Data Processing Agreement (DPA) governing specific consulting or managed service engagements — where a conflict exists, the signed agreement controls.


2. Who We Are

Atomic Computing is an AWS Advanced Tier Consulting Partner providing cloud migration and modernization, application development, cybersecurity and compliance readiness, GenAI/Agentic AI engineering, and managed cloud services, with operations across the United States, Europe, and the Middle East.


3. Use of the Website

3.1 Permitted Use

You may use the Website for lawful purposes only, including researching our services, submitting inquiries, and downloading publicly available materials (e.g., service flyers, portfolio decks).

3.2 Prohibited Use

You agree not to:

  • Use the Website in any way that violates applicable law or regulation
  • Attempt to gain unauthorized access to our systems, networks, or data
  • Introduce malware, viruses, or other harmful code
  • Scrape, harvest, or misuse content without our prior written consent
  • Impersonate Atomic Computing or misrepresent your affiliation with us
  • Use automated means (bots, scrapers) to access the Website except as permitted by robots.txt

4. Intellectual Property

All content on the Website — including text, graphics, logos, service descriptions, portfolio materials, competency badges, and design elements — is the property of Atomic Computing or its licensors (including AWS partner badge assets used under license from Amazon Web Services) and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print content for personal or internal business evaluation purposes only. You may not reproduce, distribute, modify, or create derivative works from our content for commercial purposes without our prior written consent.

Third-party trademarks referenced on the Website (including “AWS,” “Amazon Web Services,” and partner/technology logos such as Snowflake, GitHub, Wazuh) are the property of their respective owners and are used to accurately describe our partnerships and certifications.


5. Service Engagements

5.1 Scope

Descriptions of our services (e.g., Migrate, Modernize, Secure, Comply, Operate, Optimize, Build, Innovate) on the Website are provided for informational purposes and do not constitute a binding offer. Actual services, deliverables, timelines, and pricing are defined exclusively in a signed SOW or MSA between you and the applicable Atomic Computing entity.

5.2 Free Assessments and Consultations

Where we offer a “Free Assessment,” “Free Cloud POC,” or similar no-cost engagement, such offers are provided at our discretion, may be subject to eligibility criteria, and do not obligate either party to proceed with a paid engagement.

5.3 Client Responsibilities

Where you engage us for services, you agree to provide accurate information, timely access to necessary systems/personnel, and to comply with the terms of the applicable SOW/MSA.


6. Third-Party Links and Partner Programs

The Website may reference or link to third-party platforms (e.g., AWS Partner Network, Redington, Ingram Micro, OpenAI). We do not control and are not responsible for the content, policies, or practices of third-party sites. Inclusion of a partner or client logo does not imply endorsement beyond the specific partnership or engagement described.


7. Disclaimers

7.1 “As Is” Basis

The Website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Atomic Computing disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 No Guarantee of Results

While we reference successful project deliveries and client outcomes, past results do not guarantee similar outcomes for future engagements, which depend on factors specific to each client’s environment and requirements.

7.3 Availability

We do not guarantee the Website will be uninterrupted, secure, or error-free, and reserve the right to suspend or modify the Website at any time without notice.


8. Limitation of Liability

To the fullest extent permitted by applicable law, Atomic Computing and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Website. This limitation does not apply to liability arising from a separately signed SOW/MSA, which is governed by the liability terms specified therein, nor does it limit liability that cannot be excluded under applicable law.


9. Indemnification

You agree to indemnify and hold harmless Atomic Computing, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Website or violation of these Terms.


10. Privacy and Data Protection

Our collection and use of personal information in connection with the Website is governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.


11. Governing Law and Jurisdiction

These Terms are governed by the laws applicable to the Atomic Computing entity with which you primarily interact, as follows, without regard to conflict-of-law principles:
  • Visitors primarily engaging with Atomic Computing Inc (USA): governed by the laws of the Commonwealth of Pennsylvania, USA
  • Visitors primarily engaging with Atomic Computing Deutschland GmbH (Germany): governed by the laws of Germany
  • Visitors primarily engaging with Atomic Computing FZCO (UAE): governed by the laws of the United Arab Emirates and applicable free zone regulations
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in the relevant entity’s home jurisdiction, unless otherwise agreed in a signed MSA.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The “Last Updated” date above reflects the most recent revision. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.


13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
